ATF’s Tyrannical Gun Control Rule Blocked by Gun Owners of America

In a significant victory for Second Amendment advocates, a federal judge issued a temporary restraining order (TRO) against the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) just hours before a controversial new rule was set to take effect.

This ruling, brought about by the efforts of Gun Owners of America (GOA) and Texas Attorney General Ken Paxton, temporarily halts the enforcement of the ATF’s “engaged in the business” rule, also known as the Universal Registration Check rule. This rule would have expanded the definition of a gun dealer and imposed stricter regulations on private firearm sales.

The conflict began in 2022 when the bipartisan Safer Communities Act was passed, altering the definition of a gun dealer by a few words. Despite fierce opposition from GOA, the bill was signed into law, providing President Biden with the leverage to weaponize it against gun owners. GOA had warned that this change could lead to backdoor universal background checks, mirroring an attempt by the Obama Administration. These concerns materialized when the Biden Administration issued an executive order directing the Attorney General to move towards universal background checks without additional legislation.

The ATF’s new rule, named “Engaged in the Business as a Dealer in Firearms,” broadened the criteria for requiring a Federal Firearms License (FFL). The rule suggested that even selling a single firearm, or offering to do so, could necessitate an FFL. This drastic change would mean that private individuals selling firearms, potentially even to family members, could be presumed to be engaging in business as a firearms dealer.

Faced with the impending enforcement of this rule, GOA mobilized quickly. Alongside several states, including Texas, Utah, Mississippi, and Louisiana, as well as organizations like the Tennessee Firearms Association and the Virginia Citizens Defense League, GOA filed a lawsuit challenging the rule. The case was heard by Judge Matthew Kacsmaryk in the Northern District of Texas.

Judge Kacsmaryk issued a TRO, effectively blocking the ATF from enforcing its new definition of “engaged in the business as a dealer in firearms.” This decision currently protects GOA members, as well as members of the Tennessee Firearms Association and Virginia Citizens Defense League, until June 2nd. The judge identified several critical flaws in the ATF’s rule:

  1. False Assertions by the ATF: The ATF claimed that even a single firearm transaction could require an FFL, which the judge deemed incorrect.
  2. Profit Requirement Misinterpretation: The ATF suggested that actual profit was not necessary to be considered engaged in business, only the intent to earn a profit. The judge ruled that this interpretation was not supported by the statute.
  3. Safe Harbor Provision Misinterpretation: The judge noted that the ATF’s rule incorrectly excluded firearms collected for personal protection from the safe harbor provision.
  4. Reversal of Burden of Proof: Perhaps most critically, the judge condemned the ATF for requiring firearm owners to prove their innocence, rather than the government proving their guilt.

This TRO is a significant setback for the ATF and the Biden Administration’s efforts to implement stricter gun control measures through executive actions. The ruling underscores the judiciary’s role in checking regulatory overreach and protecting constitutional rights. However, the ATF may appeal the decision, and further legal battles are likely.

GOA is calling on Congress to take action to permanently block this rule. Representatives Andrew Clyde and Senator John Cornyn have introduced joint resolutions of disapproval under the Congressional Review Act (CRA), which could reverse the ATF rule if passed. GOA urges supporters to contact their elected officials to support these resolutions (HJR 144 and SJR 883) and reinforce legislative oversight over federal agencies.
